new division line between Lot 2 and Lot 5 N 07 deg. 45' 50" W 141.68
feet to a railroad spike set in the center of an access road, corner to Lot
1, Lot 2 and Lot 5; thence with a new division line between Lot 1 and
Lot 2 N 21 deg. 23' 06" W 248.43 feet re-crossing an existing right-of-
way to the beginning, containing 1.29 acres, more or less, as shown
on a plat of a survey done in August and September, 1984, by Larry
L. Kitzmiller, L.L.S. #280, a copy of said plat being found of record in
said Clerk's Office in Map Cabinet 1, Envelope 139B, and shown as
Lot 2 thereon.
And for the consideration aforesaid, the Grantor further grants and
conveys unto the Grantees, its successors and assigns, a right-of-way
16 feet wide extending form the "Old Eglon Road" to the lot herein
conveyed, which right-of-way shall not be exclusive, but shall be used
in conjunction with other parties. Said right-of-way is set out on the
plat hereinabove referred to and which crosses Lot 1, Lot 4 and Lot 5 to
Lot 2. This conveyance is subject to a reservation in Deed Book 527,
at Page 39, by Wilda A. Wilt unto herself, her heirs and assigns, the
use of said right-of-way to obtain access to and from other adjoining
property of the Wilda A. Wilt, her heirs and assigns, this right-of-way
shall be used in conjunction with other persons and all parties who use
the same shall be responsible for the upkeet and maintenance of the
same, equally.
The Grantor further grants and conveys unto the Grantees, its
successors and assigns, a right-of-way 16 feet wide, which right-of-
way gives access to and from U.S. Route 50 and the 'Old Eglon Road"
as is set out on the plat hereinabove referred to and which right-of-
way is located on Lot 1 across the lot herein conveyed to Lot 3 and
Lot 6. Wilda A. Wilt, predecessor in title, reserved in Deed Book 527,
at Page 39, unto herself, her heirs and assigns, the use of.said right-
of-way to obtain access to and from other adjoining property of the
Grantor, her heirs and assigns, and this right-of-way shall be used in
conjunction with other persons and all parties who use the same shall
be responsible for the upkeep and maintenance of the same, equally.
The lot herein conveyed is further subject to those certain rights-of-
way for the use of a septic system and water line as more fully set forth
and described in that certain Deed of Conveyance from Wilda A. Wilt,
divorced, to Olive M. Beckman, by Deed dated November 28, 1964,
and of record in said Clerk's Office in Deed Book 516, at Page 440.
The real estate herein conveyed is further subject to that certain right-
of-way for the owners of "Oak, Maple, Keystone, Sycamore, Laurel
and Linden" to use the driveway as shown on a plat of record din said
Clerk's Office in Deed Book 215, at page 85, and also set forth on said
plat found of record in said Clerk's Office in Map Cabinet 1, Envelope
139B.
SUBJECT, however, to all reservations, covenants, restrictions,
conditions and out conveyances as contained in prior deeds or record.
TOGETHER, with the buildings and improvements thereon, and the
rights, roads, ways, waters, privileges and appurtenances thereunto
belonging or in anywise appertaining.
At the time of the execution of the deed of trust, this property was
reported to have a mailing address of Rt. 1, Box 217B, Aurora, WV
26705.
AND BEING the same real estate which was conveyed to William M.
Reeves, by deed dated April 16, 1997, from Sheila A. Reeves, and recorded
in the Office of the Clerk of the County Commission of Preston County,
West Virginia, in Deed Book 598, at Page 434.
The above described property will be sold subject to any covenants,
restrictions, easements, leases and conditions of record, and subject to any
unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Trustee shall be
under no duty to cause any existing tenant or person occupying the subject
property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with
the balance due and payable within 30 days of the day of sale.
