WASTEWATER DISCHARGES FROM HIGHWAY OR PESTICIDE
GENERAL PERMIT
FOR POINT SOURCE DISCHARGES
WV/NPDES PERMIT NO. WV0116645
The Division of Water and Waste Management is proposing to issue
the General WV/NPDES Water Pollution Control Permit to regulate the
discharge of wastewater into the waters of the State from the application
of {1) biological pesticides or (2) chemical pesticides that leave a residue
(hereinafter collectively "pesticides"), when the pesticide application is for
one of the following pesticide use patterns:
1. Mosquito and Other Flying Insect Pest Control - to control public
health/nuBance and other flying insect pests that develop or are present
during a portion of their life cycle in or above standing or flowing water.
P~ Nic health/nuisance and other flying insect pests in this use category
include mosquitoes and black flies.
2. Aquatic Weed and Algae Control - to control weeds, algae, and
pathogens that are pests in water and at water's edge, including ditches
and/or canals.
3. Animal Pest Control - to control animal pests in water and at water's
edge. Animal pests in this use category include fish, lampreys, insects,
mollusks, and pathogens,
4. Forest Canopy Pest Control - application of a pesticide to a forest
canopy to control the population of a pest species (e.g., insect or pathogen)
where to target the pests effectively, a portion of the pesticide unavoidably
will be applied over and deposited to water."
The General Permit will authorize the operation and maintenance of
establishments engaged in pesticide applications or parts thereof, and
the direct discharge of treated was[ewater to the waters of the State. It is
proposed that this General Permit be issued for a five (5) year term. This
permit shall only be issued if EPA's final Pesticide General Permit is issued.
The Director of the Division of Water and Waste Management retains
authority to require any owner/operator to apply for and obtain an individual
WV/NPDES Permit. This authority will be exercised when the Director
determines that such individual permit will better protect the receiving water.
The Draft" Permit and Fact Sheet may be inspected by appointment
between 8:00 a.m. and 4:00 p.m., Monday through Friday at the Department
of Environmental Protection, Division of Water and Waste Management,
Public Information Office, 57th Street SE, Charleston, WV 25304. Copies
of the documents may be obtained from the Division at a nominal cost.
Any interested persons may submit written comments on the Draft Permit.
Comments will be accepted until September 23, 2011. They should be

its waterworks system' consisting of construction of 21,845 linear feet of
6-inch water pipe, 29 six-inch gate valves, 51 residential services taps and
meter settings, 13 fire hydrants, one pressure reducing valve station, and
appurtenances relating thereto to serve 51 new customers along John On
Road, Pell Road rish Ridge Road, Shady Lane, Pratt Hill Road, Bird's
~ .Creek Road and Mankins Road.

DELAYED PAYMENT PENALTY
The above schedule is net. On all accounts not paid in full when due, ten

TAP FEE
The following charge is to be made whenever the utility installs a new tap
to serve an applicant:
A tap fee of $350.00 will be charged to customers who apply for service
outside of a certificate proceeding before the Commission for each new tap
to the system.

To be charged whenever the supply of water is turned off for violation of
rules, non-payment of bills or fraudulent use of water.
PRIVATE FIRE PROTECTION SERVlCF
Where connections, hydrants, sprinklers, etc., on private property are
maintained by consumer: $150.00 annual fee.

$0.85 per 1,000 gallons is to be used when the bill reflects unusual
consumption which can be attributed to eligible leakage on the customer's
side of the meter. This rate shall be applied to all such consumption above
the customer's historical average usage.
RETURNED CHECK CHARGE
A service charge equal to the actual bank fee assessed to the District or
a maximum of $25.00 will be imposed upon any customer whose check for
payment of charges is returned by their bank due to insufficient funds.

A deposit of $450.00 or two-twelfths (2/12} of the average annual usage of
the applicant's specific customer class, whichever is greater. The District has no resale customers.
The requested rates and charges are only a proposal and are subject to
change (increases or decreases) by the Public Service Commission in its
review of this filing.
Anyone desiring to protest or intervene should file a written protest
or request to intervene within thirty (30) days following the date of this
publication unless otherwise modified by Commission order. Failure to timely
protest or request to intervene can affect your right to protest aspects of this
certificate case, including any associated rate increases, or to participate in
future, proceedings. All protests or requests to intervene should briefly state
the reason for the protest or request to intervene. Requests to intervene
must comply with the rules on intervention set forth in the Commission's
