A MANDATORY Pre-Bid Conference, for Prime Contractors only,

Notice of Petition for Forfeiture
Any claimant of the property described below has the right to file a claim
in the Office of the Circuit Clerk of Preston County not more than 30 days
after the first publication of this Notice. Any such claim must clearly state the
identity of the claimant and an address where legal process can be served
upon that claimant.
Now comes the Petitioner, Dallas D. Wolfe, III, Sheriff of Preston County,
by Mel Snyder, Prosecuting Attorney of Preston County, and petitions the
Court for forfeiture of certain seized property pursuant to West Virginia Code
§60A-7-701, et seq. In support thereof, the Petitioner avers as follows:
1 .Petitioner is Dallas D. Wolfe, III, the duly elected Sheriff of Preston
County.
2.Respondent is Christopher James Barber, whose last known address is:
2712 Fairfield Drive, Roanoke, VA 24012.
3.Description of Property_ Seized: The property seized (outlined in
the police report prepared by Preston County Deputy Sheriff Geisel) is
personal property.and consists of: (1) a 2003 Chevrolet S-10 truck bearing
VIN 1GCCT19X438112574 and Va. License Plate No. XDB8906; (2) Six
Hundred Thirty-Three Dollars ($633.00) in U.S. Currency; (3) various
controlled substances including marihuana; mushrooms; and various
substances'and pills; and (4) other items of drug paraphernalia.
4. Who was responsible for the seizure of the personal property: The
seizure of the property was accomplished by Deputy Sheriff R.A. Geisel
with assistance of other officers employed by the Preston County Sheriff's
Department.
5. Time and place of seizure: The property was seized on July 14th 2011
at the entrance to the All Good Festival near Masontown, Preston County,
West Virginia.
6. Identity. of the owner or owners of the seized personal property:
Christopher James Barber was the owner of the personal property identified
in paragraph 3 above at the time of seizure because he was the registered
owner of the 2003 Chevrolet S-10 Truck and the remaining items were in his
possession at the time of their seizure.
7. Identity. of the person or persons in possession of the seized personal
property_ at the time seizure: Christopher James Barber was in possession
of the personal property identified in paragraph 3 above at the time of
seizure.
8. probable cause for belief that the seized property_ is sub_iect to forfeiture:
Deputy Geisel observed a passenger frequently getting in and out of a
red Chevrolet S-10 truck while waiting at Gate 2 to enter the "All Good
Festival" located in the Valley area of Preston County. Deputy Geisel asked
K-9 handler Sgt. McFerrin to perform a free air sniff around the outside
of the S-10 truck with his K-9 unit. The K-9 alerted around the outside of
the vehicle indicating the presence of controlled substances in the vehicle.
All vehicles entering the All Good Festival are subject to search as a
condition of their privilege to attend the festival. Deputy Geisel identified the
driver of the vehicle as Christopher James Barber and the passenger as
Archibald Gibson IV. They had traveled from Virginia to attend the Festival.
A search of the vehicle was conducted and Deputy Geisel and other
officers discovered a large amount of marijuana, a large bag of mushrooms
containing psilocybin/psilocyn, and various other controlled substances.
Deputy Geisel also found $633 in U.S. currency on the person of the driver,
Christopher James Barber. Christopher Barber admitted the he knew the
controlled substances were in the vehicle, but denied they belong to him.
9. Upon information and belief, the owner of the above-described seized
vehicle is the accused, Christopher James Barber. Upon information and
belief, the owner of the above-described contraband is the accused. Your
Petitioner does not know of any other person with any ownership interest in
the property sought to be forfeited.
Wherefore, your Petitioner prays for an Order directing the forfeiture of the
seized property to the State and vesting ownership of said property with the
State and such other and further relief as the Court finds just.

taxes and recording fees connected and associated with the sale and
